FormBharo Refund Policy

1. INTRODUCTION

This Refund Policy governs the refund process for all products and services offered by FormBharo.com, owned and operated by BODHI TREE VENTURES PRIVATE LIMITED ("Company", "we", "us", or "our"). By purchasing or availing any of our services, you ("User" or "Customer") agree to the terms and conditions outlined herein.

This policy is framed in accordance with applicable Indian consumer protection laws, Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023, ensuring transparency and fairness in all financial transactions.

2. SCOPE

This policy applies to all online and offline payments made to FormBharo.com for services such as:

• Exam Form Filling Assistance
• Admission Counselling
• FormBharo Premium or Subscription Services
• College Application Assistance
• Any other add-on or bundled services offered by the Company or its authorised partners.

3. General Principles

• All payments are final once the service has commenced or the form has been submitted on behalf of the user.
• Refunds are applicable only in limited and verifiable cases, as mentioned in this policy.
• Refunds, where approved, will be processed to the original mode of payment only.
• The Company reserves the right to approve or reject any refund claim based on internal verification and audit.

4. ELIGIBLE SCENARIOS FOR REFUNDS

Refunds shall be considered only under the following circumstances:

• Duplicate or Multiple Payments: If a user has been charged more than once for the same transaction, the excess amount will be refunded within 3–5 working days after verification.
• Payment Error or Technical Failure: In case of failed or incomplete transactions due to network or payment gateway issues, where the amount has been deducted but service not activated, the amount will be refunded after confirmation from the payment processor.
• Non-Delivery of Service by Company: If the Company is unable to deliver the promised service due to its own fault or technical constraints, a full or partial refund may be issued upon internal review.
• Cancelled Exam or Admission Process by the Institution: If an exam or admission process is officially cancelled by the concerned authority or institution, users must first seek a refund directly from the respective body.
• The Company may process a pro-rata refund only if explicitly authorised by that institution.

5. Non-Refundable Scenarios

No refund shall be issued under the following conditions:

• Once a form is successfully submitted to the target institution or examination authority.
• When the counselling or advisory session has been completed or initiated.
• For ineligibility, incorrect data submission, or withdrawal of application by the user.
• When services are provided by third-party vendors or partner institutions, governed by their own refund rules.
• Where a refund request is raised beyond 10 days from the date of payment.
• When a user's access is terminated due to a policy violation, fraudulent activity, or misrepresentation.

6. REFUND PROCEDURE

To initiate a refund request, the User must:

• Registered name and email ID
• Transaction ID or Payment Reference Number
• Date and amount of payment
• Reason for refund request
• Supporting documents or screenshots (if applicable)

The Company will acknowledge the request within 5 working days and may seek additional information or clarification.

Upon approval, refunds will be processed within 10–30 working days, depending on banking and payment-gateway timelines.

7. REFUND DEDUCTIONS

All refunds, where applicable, are subject to:

• Administrative charges (up to ₹200 or 5% of transaction value, whichever is higher).
• Gateway fees charged by banks or payment processors, which are non-refundable to the Company.
• Taxes or government levies paid at the time of transaction, where refund is not permissible by law.

8. MODE OF REFUND

Approved refunds will be processed only to the original payment source — such as credit card, debit card, UPI, or bank transfer — used at the time of purchase.

The Company does not issue refunds in cash, vouchers, or third-party wallets.

9. Chargebacks and Fraudulent Claims

• Any attempt to raise false chargeback requests or initiate disputes without prior communication will be treated as a breach of contract.
• The Company reserves the right to: Suspend or terminate such user accounts; Initiate legal recovery or report fraudulent activity to relevant authorities under the Information Technology Act, 2000 and Indian Penal Code, 1860.

10. CANCELLATION OR TRANSFER OF SERVICES

Service once purchased cannot be transferred to another user or service category.

Requests for conversion, substitution, or adjustment between different packages or plans are not permitted.

11. DATA AND PRIVACY COMPLIANCE

All refund requests involve the processing of limited personal data (such as transaction identifiers and contact details).

Such data is handled strictly in compliance with the Digital Personal Data Protection Act, 2023, and used only for legitimate refund verification and accounting purposes.

14. GOVERNING LAW AND JURISDICTION

This Refund Policy is governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts at Jabalpur, Madhya Pradesh.
